node.this Terms of Use

This English version is provided for convenience. In case of discrepancy, the French version prevails.

1. Purpose
#

These terms of use (the “Terms”) govern access to and use of the node.this service, as offered online at node-this.tyo-data.fr (the “Service”) by TYO DATA, whose details are given in the legal notice.

node.this is a no-code application for building data processing flows visually: file import, transformations, statistics, visualisations, reports and exports.

The Terms apply to every person who creates an account, whatever the plan. Paid plans (Pro, Team) are also governed by the Terms of Sale, which prevail over the Terms in case of conflict. An installation of node.this on a customer’s own infrastructure (on-premise) is governed by a separate contract and is not covered by the Terms.

2. Acceptance
#

Creating an account constitutes acceptance of the Terms in their current version. Acceptance is requested at sign-up. Without it, the Service cannot be used.

3. Account and access
#

Creation. An account is created with an email address, which must be verified, or with a Google account. No other sign-in method is offered.

Identity. An account is personal. Credentials must not be shared, and the user is responsible for any use made of their account.

Professional use. The Service is reserved for professional use, the free plan included: the user acts in the course of their occupation (as an employee, as a self-employed person, in research or in teaching), or on behalf of the organisation that employs them, to the exclusion of any use as a consumer. By creating an account, they declare that they act in that capacity.

Linking two sign-ins. node.this never automatically links two accounts that share the same email address. A person who signs in with a different method from the one used at sign-up may therefore end up with a second account, without access to their projects.

4. The Service and its plans
#

The Service is offered in several plans, described in the price list: a free trial plan (Free) and paid plans (Pro, Team). Each plan sets in particular the storage available for data, the number of runs executed at the same time, read-only sharing, collaboration and the number of interactions with the AI assistant.

Projects belong to a space: the user’s personal space, or the space of a team they are a member of. The plan applies to the space, not to the person: the same person may have a personal space on Free and be a member of a team on Team.

When a plan limit is reached, the Service refuses the operation that would exceed it (an upload, a share, starting a run). It never deletes data to get back under the limit.

The free plan is a trial. It allows the Service to be used for 30 calendar days from the creation of the space, or until its runs have consumed 300 minutes of computation, the trial ending when the first of these two limits is reached. A minute of computation is one minute spent executing a run; a result already computed and reused as is consumes none. The trial requires no means of payment. Its end date and the minutes left are shown in the interface, in the account panel.

When the trial ends, the space is frozen. Nothing is deleted because the trial has ended: the projects of the space remain viewable and exportable (section 6), and their Word reports can still be produced. A run can still be started again as long as all its results have already been computed; no new computation is performed and no data can be imported into a frozen space. A change to the Service (section 8) may require a run that has already been executed to be computed again: in a frozen space, that run can then no longer be started again, but the results already obtained remain viewable and exportable. The freeze ends when the space moves to a paid plan.

A space that returns to the free plan at the end of a paid plan is frozen from that moment if its trial has ended; it does not receive a new trial. TYO DATA may, at its discretion and on request sent to the address in section 14, extend a trial; one extension creates no commitment to another.

The free plan is provided free of charge and without support.

5. Use of the Service
#

The user undertakes:

  • to import only data they are entitled to process, and to comply with the legal and sector-specific obligations attached to it;
  • not to use the Service for unlawful purposes;
  • not to attempt to access data, projects or accounts that are not theirs;
  • not to harm the security or operation of the Service, in particular by trying to circumvent its limits, by automated and abusive use, or by introducing malicious code;
  • not to resell or provide access to the Service to third parties outside the sharing features it offers.

Health data and sensitive data. The online Service is not suited to processing health data, nor the other special categories of data within the meaning of Article 9 of the GDPR, and is not a certified health data host (HDS in French law). The user refrains from importing such data. Any such processing is under their sole responsibility. An organisation that must process such data can use an installation of node.this on its own infrastructure (on-premise), which is governed by a separate contract.

6. User data
#

Ownership. The user remains the owner of the data they import and of the results they produce. TYO DATA uses this data only to provide the Service: storing it, processing it at the user’s request, displaying it and exporting it. It is never used to train a model or for commercial purposes.

Measuring use. To size the Service and design its plans, TYO DATA uses the history of runs: their number, their duration, the operations used and the space’s plan. For this, it never reads the content of the data, flows or results. The details are in the privacy policy.

Responsibility. The user is solely responsible for their data, its lawfulness, the configuration of their flows and the interpretation of the results obtained.

Retention. node.this keeps data and flows for as long as the account exists, so a flow can always be run again on its current data. The run history, however, is bounded: for each flow, node.this keeps the latest 30 runs started automatically (by an API key, a schedule or the arrival of new data). Runs started by the user, by hand or by the editor after each change, are temporary: only the latest state of the flow and the latest run started by hand are kept. The others are deleted, with their results. A run the user pins is kept for as long as the account exists: this is what makes it possible to replay it with identical results, on the exact data it read. The same applies in a space frozen at the end of its trial (section 4). Apart from this bounded history, no data is deleted automatically, except in the case set out in section 11.

Backups. TYO DATA backs up the Service for its own continuity needs, but does not undertake to restore a user’s data. Backups are not a service provided to the user, who keeps their own copies of important data.

Export. Every project can be exported at any time from the interface, in open and documented formats (Parquet for tables, JSON for flows, dictionaries and the theme), and re-imported into node.this. Export is done project by project; it includes neither the run history nor the sharing settings.

Personal data contained in projects. The data the user imports may contain personal data, including data about third parties. For such data, the user, or the organisation they act for, is the controller, and TYO DATA acts as a processor within the meaning of Article 28 of Regulation (EU) 2016/679 (GDPR). Whatever the plan, TYO DATA undertakes to:

  • process this data only to provide the Service, on the user’s instructions as given by their actions in the interface;
  • keep it confidential, its authorised staff being bound by confidentiality;
  • view its content only at the user’s written request, and within the limits of that request, except where required by law, in which case the user is informed where the law allows;
  • implement the security measures described in the privacy policy, in particular encryption of data at rest;
  • use only the sub-processors named in the privacy policy, and give the user notice before any change, under the conditions below;
  • assist the user, as far as possible, in answering requests from data subjects, in particular through the export and deletion provided for in the Terms;
  • notify the user of any personal data breach concerning them without undue delay and, where possible, no later than 48 hours after becoming aware of it, so that they can meet their own obligations towards the supervisory authority, and document every breach, whether notified or not;
  • delete this data when the account or the space is deleted, under the conditions of section 11;
  • make available the information needed to demonstrate compliance with these obligations, and allow audits, under the conditions below.

Change of sub-processor. TYO DATA notifies the user by email at least 30 days before adding or replacing a sub-processor, naming it and stating what it will do. The user may object during that period, on legitimate grounds relating to data protection, by writing to rgpd@tyo-data.fr. The parties then look for a solution; failing one, the user may delete their account, and a paying customer may terminate under the conditions of the Terms of Sale (section 12). Where a replacement is urgently required for the security or continuity of the Service, the user is notified as soon as possible, with the same right to object.

Audit. The user may verify compliance with these commitments, themselves or through an auditor they appoint.

  • Documents first. On request, TYO DATA provides its security file (location and encryption of data, backups, sub-processors, access, handling of a breach) and answers a security questionnaire, free of charge, once a year.
  • On site, if the documents are not sufficient, after a security incident, or at the request of a supervisory authority. The audit is announced at least 30 days in advance, takes place at most once a year and lasts at most one business day, during office hours. The auditor is bound by confidentiality and is not a competitor of TYO DATA. A request from a supervisory authority is not subject to these limits.
  • The host’s data centres are not audited by this means: the host’s certifications stand in for it.
  • Costs. The user bears their own costs and those of their auditor. The time TYO DATA spends on an on-site audit is invoiced to the user at TYO DATA’s then-current daily rate for its services, communicated and accepted before the audit. Nothing is invoiced if the audit reveals a material breach of these commitments by TYO DATA, which it then remedies at its own expense.

For a customer on a paid plan, the data processing agreement (DPA) provided for by the Terms of Sale (section 12) restates and details these commitments; in case of contradiction, the DPA prevails.

Account data. The processing of the account’s personal data, for which TYO DATA is the controller, is described in the privacy policy.

7. The AI assistant
#

The Service may offer an assistant that helps build flows. In paid plans, it is provided by TYO DATA and sends to a language model provider hosted in France (Scaleway):

  • the request written by the user;
  • the names of the project’s tables and the names and types of their columns;
  • the current flow, including the configuration of each node, which may contain values (a filter value, category levels, or the content of a table typed in by hand).

The content of imported tables is never sent.

In paid plans, the assistant provided by TYO DATA is included up to the number of interactions set out in the price list. Beyond that limit, the user may carry on by entering their own key.

In the free plan, the assistant provided by TYO DATA is not included. Whatever their plan, the user may enter their own key from one of the providers offered in the assistant panel. These elements are then sent to that provider, under the user’s account and that provider’s terms:

Before the key is entered, the panel shows the chosen provider and the country the data goes to. Whether requests are used to train models depends on the provider, and is governed by the contract between the user and that provider:

  • Mistral AI: on by default for its API, paid plans included; it can be turned off in the Mistral console (Admin, Privacy, Anonymous improvement data);
  • OpenAI and Anthropic: off by default for their API, unless the user opts in with them.

These are the rules the providers published on 16 September 2026; they may change, and it is up to the user to read them. The key is used only for the duration of the request and is not kept.

This provider is the user’s own service provider, not a sub-processor of TYO DATA. The user chooses it, contracts with it and accepts its terms; TYO DATA only passes the request on to it, at the user’s request and for the duration of that request. A user acting on behalf of an organisation declares, by entering their key, that the organisation has authorised them to do so, in particular for that organisation’s data contained in the request. They do so under their sole responsibility.

The assistant’s proposals are suggestions that the user reviews and approves before running them. They may be wrong; TYO DATA does not guarantee that they are correct.

8. Availability and changes
#

The Service is provided as is, with no availability commitment. TYO DATA endeavours to keep it accessible and announces planned maintenance at least 48 hours in advance. Unplanned interruptions may occur.

The Service evolves: features may be added, changed or removed. A run already executed keeps its results for as long as it belongs to the retained history (section 6).

9. Intellectual property
#

The node.this software, its interface, its documentation and its trademarks are the property of TYO DATA. The Terms grant the user a personal, non-exclusive right to use the Service for the lifetime of their account. They transfer no right in the software.

10. Liability
#

TYO DATA uses reasonable means to provide the Service. It cannot be held liable for the user’s data, its accuracy or lawfulness, the processing the user configures, the interpretation of results, or interruptions caused by a third-party provider.

To the extent permitted by law, TYO DATA is not liable for indirect damage, including loss of business, revenue or opportunity.

As the free plan is a trial provided free of charge, TYO DATA cannot be held liable for its use, to the extent permitted by law. TYO DATA’s liability towards a customer on a paid plan is governed by the Terms of Sale (section 13).

11. Suspension, deletion and inactivity
#

Deletion by the user. The user can delete their account at any time from the interface. Deletion erases their projects, their data and their sign-in identity. An account that owns projects shared with other people cannot be deleted until those projects have been deleted or handed over: deleting them would take away the work of people who have not been warned. Deleted data disappears from backups within 30 days at the latest.

Deletion on request. The user can also request the deletion of their account by email at rgpd@tyo-data.fr, from that account’s address. TYO DATA carries it out within 30 days, with the same effects and the same reservation for shared projects, and gives a certificate of deletion on request.

Suspension by TYO DATA. TYO DATA may suspend or delete an account that does not comply with the Terms, in particular section 5, or that endangers the security of the Service. Except in an emergency, the user is informed by email.

Inactivity. A free-plan space, including a space frozen at the end of its trial, none of whose members has signed in for 12 months may be deleted, after a warning sent by email at least 30 days before deletion. Any sign-in by a member, including to view or export a frozen project, restarts this period. A paid-plan space is never deleted for inactivity while its subscription is running.

12. Changes to the Terms
#

TYO DATA may change the Terms. The new version is published on this page at least 30 days before it comes into force, and holders of a paid plan are also informed by email. A user who refuses it may delete their account before that date; otherwise the new version applies from the announced date. A change required by law or by an authority may apply without this notice period.

13. Governing law and language
#

The Terms are governed by French law. In case of dispute, the parties first seek an amicable solution; failing that, jurisdiction lies with the courts within the jurisdiction of the Paris Court of Appeal.

The Terms are written in French and translated into English. In case of discrepancy, the French version prevails.
